Terms of sale

TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale govern all purchases made through The Watch Broker.

By placing an order on our website, you acknowledge that you have read and accepted these Terms and Conditions of Sale, subject to any mandatory rights available to you under applicable law.

1. Seller Information

Trading Name: The Watch Broker
Address: 1234 Commerce Blvd, Suite 100, Houston, TX 77002, United States

2. Products

The Watch Broker offers luxury watches and related products, including new and pre-owned timepieces where specified.

The essential characteristics of each watch are presented on the relevant product page before purchase. Depending on the product, this information may include:

  • Brand and model

  • Reference number

  • Case material and dimensions

  • Movement

  • Dial and bracelet or strap information

  • Water resistance

  • Condition

  • Included accessories

  • Box and papers, where applicable

We make reasonable efforts to ensure that product descriptions, specifications, photographs, and other information are accurate.

For pre-owned watches, normal signs of previous ownership may be present. Relevant known condition information should be reflected in the product description and/or photographs where applicable.

3. Product Images and Condition

Photographs and videos displayed on our website are intended to represent our watches as accurately as reasonably possible.

Colors, reflections, finishes, and other visual characteristics may appear slightly different depending on lighting conditions, photography, and the customer's screen.

Customers should carefully review the photographs, description, condition information, and specifications before placing an order.

Where a watch is sold as pre-owned, reasonable signs of previous use that have been accurately disclosed do not automatically constitute a defect or lack of conformity.

4. Authenticity

Authenticity is an important part of our approach at The Watch Broker.

We take reasonable measures to assess the watches we offer and the information available to us before listing them for sale.

Depending on the timepiece, this may include consideration of identifying characteristics, components, reference information, condition, documentation, and other relevant factors.

Unless expressly stated otherwise, any authenticity assessment performed by The Watch Broker should not be interpreted as an official certification by, endorsement from, or affiliation with the original watch manufacturer.

Nothing in this section limits any mandatory rights relating to counterfeit, misrepresented, defective, or otherwise non-conforming products.

5. Product Availability

All watches are offered subject to availability.

Certain watches may be available in very limited quantities, including individual pieces.

Placing a product in your shopping cart does not necessarily reserve that product until the checkout process has been successfully completed and the order accepted.

If a watch becomes unavailable after an order has been placed, we will contact the customer as soon as reasonably possible and provide an appropriate remedy, which may include a full refund where applicable.

6. Prices

Prices are displayed in the currency applicable to the customer's selected market or location where supported.

The final amount payable will be displayed during checkout before the order is confirmed.

Applicable shipping charges and taxes collected by us will be displayed during checkout where required.

For international orders, customs duties, import taxes, VAT, brokerage charges, or other fees may apply depending on the destination country.

Where these charges are not collected by The Watch Broker during checkout, they may remain the responsibility of the recipient, subject to applicable law.

7. Orders

Customers are responsible for checking their order, selected watch, delivery information, and total price before completing payment.

After successfully placing an order, customers will normally receive an order confirmation at the email address provided during checkout.

Receipt of an automated order confirmation does not prevent us from carrying out reasonable payment, fraud-prevention, inventory, or order verification procedures where necessary.

The Watch Broker reserves the right to refuse or cancel an order where permitted by law, including in cases involving:

  • Suspected fraud

  • Unauthorized payment

  • Failed payment verification

  • Obvious pricing or technical errors

  • Product unavailability

  • Duplicate orders caused by a technical error

  • Misuse of promotional offers

If The Watch Broker cancels an order after payment has been collected, the applicable amount will be refunded.

8. Payment

Available payment methods are displayed during checkout.

Payment must be completed using one of the payment methods offered through our website.

By submitting payment information, the customer confirms that they are authorized to use the selected payment method.

Payments may be processed through secure third-party payment providers.

Additional verification may be requested where reasonably necessary to prevent fraud or unauthorized transactions, particularly for high-value purchases.

9. Shipping and Delivery

Orders are shipped to the delivery address provided by the customer during checkout.

Our standard estimated delivery time is generally:

7–10 business days

Delivery times are estimates unless a guaranteed delivery date is expressly stated.

Delivery may occasionally be affected by customs procedures, carrier delays, weather, security checks, public holidays, or other circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate delivery information.

Where available, tracking information will be provided after shipment.

Because watches may be high-value items, shipments may also require tracking, insurance, delivery verification, or a signature upon receipt where applicable.

Further information is available in our Shipping Policy.

10. International Orders

International customers may be subject to customs procedures, import restrictions, duties, taxes, VAT, brokerage charges, or other requirements imposed by their destination country.

Customers are responsible for ensuring that the watch they order can legally be imported into their destination country.

Where customs duties or import charges are not collected during checkout, they may be payable by the recipient.

Customs processing may also affect estimated delivery times.

11. Returns, Cancellations and Refunds

Returns, cancellations, refunds, and any applicable statutory withdrawal rights are governed by our Return & Refund Policy and applicable consumer protection laws.

Customers wishing to request a return should contact:

contact@thewatchbroker.com

before returning the watch.

Returned watches should generally be returned in the same condition in which they were received, together with the original accessories, documentation, packaging, tags, boxes, and other included items where applicable.

Where mandatory law provides customers with additional return or withdrawal rights, those rights remain unaffected.

12. Returned Watch Inspection

Returned watches may be inspected before a refund is processed.

The inspection may verify:

  • The condition of the watch

  • The identity of the returned watch

  • Whether all originally supplied accessories are present

  • Whether the watch has been damaged or altered

  • Whether there are signs of use beyond reasonable inspection

Where permitted by applicable law, damage, missing accessories, alteration, or excessive handling may affect the amount refundable.

Mandatory consumer rights remain unaffected.

13. Damaged, Incorrect or Non-Conforming Products

Customers who receive a damaged, incorrect, or potentially non-conforming watch should contact us as soon as reasonably possible at:

contact@thewatchbroker.com

Please provide:

  • Your order number

  • A description of the issue

  • Photographs of the watch

  • Photographs of the packaging where relevant

We will review the request and provide an appropriate remedy in accordance with applicable law.

Any mandatory statutory warranties or consumer guarantees remain unaffected.

14. Customer Information

Customers agree to provide accurate, complete, and current information when placing an order.

Customers are responsible for ensuring that their:

  • Name

  • Email address

  • Billing information

  • Shipping address

  • Contact information

are correct before completing their purchase.

The Watch Broker cannot be held responsible for delays or delivery issues resulting solely from incorrect or incomplete information provided by the customer, except where applicable law provides otherwise.

15. Fraud Prevention and Security

Due to the value of the products offered, The Watch Broker may perform reasonable security or fraud-prevention checks before processing or shipping an order.

Where reasonably necessary, we may request additional information to verify the purchaser, payment, or delivery information.

An order may be delayed or cancelled if we reasonably believe that a transaction may be fraudulent or unauthorized, subject to applicable law.

16. Personal Data

Personal information collected in connection with purchases is processed in accordance with our Privacy Policy and applicable data protection legislation.

Information may also be processed by third-party service providers involved in payment processing, fraud prevention, shipping, analytics, or operation of our e-commerce platform.

Unauthorized reproduction, distribution, modification, or commercial use is prohibited except where authorized by law or the applicable rights holder.

Third-party trademarks, watch brand names, logos, model names, and other intellectual property remain the property of their respective owners.

Unless expressly stated otherwise, The Watch Broker is an independent retailer and is not affiliated with, sponsored by, endorsed by, or an authorized dealer of a watch manufacturer merely because its products or trademarks appear on our website.

18. Liability

The Watch Broker is responsible for its obligations in accordance with applicable law.

To the maximum extent permitted by applicable law, we will not be responsible for indirect or consequential losses arising from circumstances for which liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Nothing in these Terms excludes or restricts mandatory statutory consumer rights.

19. Force Majeure

The Watch Broker will not be responsible for failure or delay in performing an obligation where the failure or delay results from circumstances outside our reasonable control and where liability may lawfully be excluded.

Such circumstances may include major transportation disruptions, natural disasters, government actions, carrier disruptions, severe weather, or other qualifying events.

20. Third-Party Brands

The Watch Broker may offer watches manufactured by independent third-party brands.

All trademarks, logos, model names, and other brand identifiers displayed on our website remain the property of their respective owners.

Unless expressly stated otherwise, the sale of a particular watch does not imply an official commercial relationship between The Watch Broker and its manufacturer.

21. Applicable Law

These Terms and Conditions of Sale are governed by the laws applicable to the business entity operating The Watch Broker, subject to applicable conflict-of-law rules and mandatory consumer protections.

Consumers residing outside the seller's jurisdiction retain any mandatory consumer protections that cannot legally be waived under the laws applicable to their situation.

Any dispute will be handled in accordance with applicable jurisdiction and consumer protection rules.

22. Changes to These Terms

The Watch Broker may update these Terms and Conditions of Sale from time to time to reflect changes to our business practices, services, website, or legal obligations.

The version generally applicable to an order is the version made available at the time the order is placed, subject to mandatory applicable law.
